In NSW, a certificate of compliance can be issued by a council officer or by a private certifier accredited by NSW Fair Trading, known as an E1 certifier. Before a sale or new lease, the pool must also be registered on the NSW Swimming Pool Register, separately from the compliance certificate. A first NSW pool inspection commonly costs somewhere between about $150 and $300, with a reinspection often cheaper.

Most fails on a NSW inspection come down to gate hardware, small gaps in the fence, or climbable objects left in the non-climbable zone. An E1 certifier's inspection checks the barrier: fence height of at least 1.2m, no gaps over 100mm under or through the fence, and a gate that self-closes and self-latches. If a certifier finds defects, they can issue a certificate of non-compliance instead, listing what needs fixing.
