Selling or leasing a property with a pool in QLD

Leasing

To lease a property with a pool, you are expected to have a valid pool safety certificate in place. A pool safety inspector licensed by the QBCC inspects the barrier and, if it passes, issues the Form 23. For a non-shared pool the certificate lasts two years, so many landlords time the inspection to cover the lease term.

Selling

Selling is a little more flexible for a non-shared pool. If you have a current pool safety certificate, you provide it. If you do not, Queensland lets the sale proceed provided you give the buyer a prescribed notice (that no certificate is in effect) before settlement. Responsibility then shifts to the buyer, who must obtain a pool safety certificate within 90 days of settlement.

Shared pools are stricter

For shared pools, such as those in unit complexes or managed by a body corporate, the certificate lasts only one year and the expectation to have it in place is firmer.
