Registering your pool: the step people forget
Before any certificate, most states require the pool to be on a public register. Here is how registration works in NSW and QLD and why it matters.
Last reviewed July 2026. Pool rules change and vary by council, so confirm the current requirement with your state authority before you act.
Registration is the quiet first step that trips owners up. You can book an inspection and still hit a wall at settlement if the pool was never entered on the state register, because the register record is part of what a buyer or tenant is entitled to see.
New South Wales
In NSW, owners must register their pool or spa on the NSW Swimming Pool Register, a free online system run by the NSW Government. Registration asks you to self-assess the barrier against a checklist and record the pool details. When you sell, evidence of registration has to be attached to the contract alongside the certificate, so an unregistered pool can stall an exchange even if the barrier is fine.
Queensland
In Queensland, pools are recorded on the pool safety register maintained through the QBCC. When a licensed inspector issues a Form 23, the certificate flows onto that register, and anyone can search an address to see whether a pool is registered and certified. Keeping the record current is part of staying sale-ready.
Why it is worth doing now
Registration is free or low cost and takes minutes, but sorting it out at the last minute before a sale is stressful and can delay settlement. If you own a pool and are not certain it is registered, checking the register today removes one of the most common last-minute surprises. This is general information, not legal advice. The authorities are NSW Fair Trading and the NSW Swimming Pool Register in New South Wales, and the Queensland Building and Construction Commission (QBCC) in Queensland. Always confirm the current rule for the state your pool is in.
